Board of Governors meets
The Board of Governors met today in Columbia.
The Board approved a recommendation to transition S.C. Bar News to an electronic publication, effective with the February 2010 issue. The newsletter will be distributed to members via e-mail and will be featured on the Bar's Web site. The Board also approved a recommendation to eliminate a limited number of sections from the Lawyers Desk Book, featuring more routinely updated information on the Bar's Web site.
A recommendation from the Unauthorized Practice of Law Committee to adopt principles for additional consumer protection was approved.
The Board approved a request to create an In-House Counsel Committee to facilitate involvement and identify common issues of this sector of membership.
The Board called for the House of Delegates in January to fill the vacancy in the office of President-Elect created by the resignation of Robert Kilgo.
The Board received reports from the Bar Foundation, ALPS, and the Task Force on Professional Potential and from Bar staff on new building progress.
The Board adopted a record retention policy for the Bar.
The following Bar members were nominated to the Lawyers' Fund for Client Protection Committee: Mark Manos, Betsy Burn, Ed Pritchard and Julie Jeffords Moose. The nominations will be forwarded to the Supreme Court.
Nominees selected
Nominees for offices in the S.C. Bar were selected in late October by the Bar's Nominating Committee. The office of President-Elect will be filled by election by the House of Delegates in January. Carl L. Solomon of Columbia who presently serves as Treasurer has been recommended by the Committee to fill the vacancy. The person elected in January will automatically succeed to the office of President in May. Members nominated were A. Marvin Quattlebaum Jr. of Greenville for President-Elect, Angus H. Macaulay of Columbia for Treasurer, Alice F. Paylor of Charleston for Secretary and Anne S. Ellefson of Greenville for Chair of the House of Delegates. Nominated for seats on the Board of Governors were Thomas E. Pope of Rock Hill for the First Judicial Region, Roy F. Laney of Columbia for the Second Judicial Region and Elizabeth B. York of Hartsville for the Third Judicial Region. Nominated to serve as ABA State Bar Delegates (a third seat having been authorized by the ABA) were Rosalyn W. Frierson of Columbia and Daniel B. White of Greenville. Section 9.3 of the Constitution of the S.C. Bar governs the nominating procedure. On January 15, 2010, the nominations close.
Bar admissions ceremony
On November 16 the Supreme Court of South Carolina conducted an admissions ceremony for new admittees and welcomed them to the S.C. Bar. To view the list of new admittees, click here.

Hackers target law firms
The FBI has issued an advisory that computer hackers are increasingly targeting law firms and public relations companies with a sophisticated e-mail scheme that breaks into computer networks to steal sensitive data, often linked to large corporate clients doing business overseas. Through "spear fishing" e-mails, hackers are sending Web links or attachments that when clicked on or opened infiltrate a firm's network. The FBI warned that the attachments or links can appear to be anything from a photo to an executable program. For more information, click here.

After being convicted of murder, armed robbery, conspiracy to commit armed robbery, and kidnapping, Cooper appealed, arguing that the trial court erred by refusing to dismiss the charges against him because his constitutional right to a speedy trial was violated, by allowing the testimony of an unavailable witness to be read into the record in violation of his constitutional right to confrontation, and by allowing evidence of his prior convictions to be presented at trial. The Court of Appeals affirmed Cooper's convictions. First, the court held that even though a presumption of prejudice had been triggered by the forty-four month delay of Cooper's trial, the trial judge's determination that the presumption of prejudice had been rebutted was supported by sufficient evidence. Next, the court held that the testimony of the unavailable witness was properly admitted because there was sufficient evidence to support the trial court's determination that the State did not act unreasonably in failing to present the witness at trial. Finally, the Court held that evidence of Cooper's prior convictions for impeachment purposes was proper because the probative value of the evidence outweighed any prejudicial effect against Cooper.
