About the Seminar
Everybody has received a class action notice in the mail. Just about every lawyer has been asked for advice from someone who received one of these notices. And recently, class actions have been the subject of United States Supreme Court and United States Courts of Appeal decisions, as well as new federal and state statutes. This changing landscape makes it more important than ever for lawyers to know about class actions and their role in our legal system.
Mark Reinhardt, who has litigated class actions in the United States Supreme Court, nearly every Federal Circuit, and many states, will clearly and concisely provide you with the information you need regarding class actions, from pre-filing strategies and consideration under the Rules of Civil Procedure, through settlement and notice issues. Some insights regarding the ethics involved in bringing a class action, and how to help your client avoid being the target of a class action will also be shared.
What You Will Learn
This short seminar should supply the practitioner with an overview of the operation of Rule 23. The major points to be covered will be:
· Recognizing a potential class action
· What type of client makes an ideal class representative
· What are the basic ethical considerations in bringing a class action
· Are there ways that a business can limit its exposure to class action litigation
· A short discussion of the class action fairness act
